Terms & Conditions

By accessing or using the Bsustain platform ("Platform"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, please do not use the Platform.

The Platform is operated by ONE BEST, Lda., a company registered in Portugal with NIPC 514694602 and registered office at Rua do Paraíso, n.º 192, 4000-375 Porto ("Bsustain", "we", "us", or "our").

Bsustain provides a web-based platform that enables organisations to prepare and generate sustainability reports in compliance with the European Union Voluntary Standard (VS), set out in Annex I to Commission Delegated Regulation (EU) 2026/1560 of 3 July 2026, published in the Official Journal of the European Union on 21 September 2026. The Voluntary Standard replaced the VSME standard recognised by Commission Recommendation (EU) 2025/1710, which ceased to produce legal effects on 24 September 2026. The Platform uses artificial intelligence to assist in drafting and enriching report content based on information you provide.

To use the Platform, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your password and account credentials.
• Notify us immediately of any unauthorised use of your account.
• Be responsible for all activity that occurs under your account.

Each account is linked to a single Tax Identification Number (NIF). Once the company NIF is registered, it cannot be substituted for another entity. The account is intended for use by the entity holding the registered NIF and may not be used to generate reports for third-party companies.

You agree not to:

• Use the Platform for any unlawful purpose or in violation of applicable regulations.
• Enter false, misleading, or fraudulent information into the Platform.
• Attempt to gain unauthorised access to any part of the Platform or its infrastructure.
• Reverse-engineer, decompile, or disassemble any part of the Platform.
• Use the Platform in a way that could damage, disable, or impair it.
• Use a single account to generate sustainability reports for multiple unrelated companies.
• Share account credentials with third parties for the purpose of bypassing the single-NIF rule.

The Platform uses artificial intelligence (powered by Anthropic) to generate and refine text in your sustainability reports, in accordance with Article 50 of EU Regulation 2024/1689 (EU AI Act) on transparency obligations for AI systems. You acknowledge that:

• AI-generated content is produced based on the data you provide and may require review and editing before publication.
• Bsustain does not guarantee the accuracy, completeness, or compliance of any AI-generated content.
• You are solely responsible for reviewing and validating the content of any report generated through the Platform before use.
• Reports generated by the Platform are clearly identified as AI-assisted in accordance with applicable transparency obligations.

The Platform, including its design, software, algorithms, automatically generated text, visual structure, report templates, and any content other than data entered by you, is the intellectual property of ONE BEST, Lda. and is protected by applicable laws.

You retain ownership of the data you enter into the Platform. By using the Platform, you grant Bsustain a limited licence to process your data for the purpose of providing the services described in these Terms.

The sustainability reports generated through the Platform are licensed to you for use within your company and to share with your stakeholders (e.g. clients, banks, partners). However, you may not:

• Reproduce the design, structure, or visual identity of the report in documents produced by other means.
• Copy or adapt automatically generated text from the Platform into other documents without attribution.
• Remove, hide, or alter the “Generated by Bsustain · bsustain.eu” mark present in shared reports, exports, or any other form of dissemination.
• Use the report or any of its components as a basis for the development of a competing product or service.

To the fullest extent permitted by applicable law, Bsustain shall not be liable for:

• Any indirect, incidental, or consequential damages arising from your use of the Platform.
• Errors or inaccuracies in AI-generated content included in your reports.
• Loss of data or business interruption.
• Decisions made by you or third parties based on report content.

The Platform processes data as reported by you and does not perform independent verification or audit of the values reported. Reports do not replace specialised legal, tax, technical, or sustainability advice.

Our total liability to you for any claim arising out of or relating to these Terms shall not exceed the amount paid by you to Bsustain in the twelve months preceding the claim.

You may close your account at any time by contacting us at info@bsustain.eu.

We reserve the right to suspend or terminate your account if you violate these Terms, with or without prior notice, including in cases of:

• Use of the account to generate reports for third-party companies (multi-client abuse).
• Attempts to reproduce, reverse-engineer, or use the Platform’s intellectual property to develop a competing product.
• Any material breach of these Terms.

These Terms are governed by the laws of Portugal. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Porto, Portugal.

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice on the Platform with at least 30 days' advance notice. Your continued use of the Platform after changes take effect constitutes your acceptance of the updated Terms.
